The Federal Regional Court of the 1st Region granted Habeas Corpus this Tuesday (17/9) to block, due to ineptitude in the complaint, the criminal action that was being carried out against Marcelo Miller and lawyer Esther Flesch, due to the episode involving the brothers' denunciation Joesley and Wesley Batista, owners of J&F. The court understood that their conduct did not constitute a crime of corruption.

The Federal Public Ministry stated that former prosecutor Marcelo Miller, in partnership with Esther, received an undue advantage of R$700,000 to help J&F (a group of which JBS is part) obtain information to close a plea bargain agreement.
Esther's lawyer, Fábio Tofic Simantob , spoke to ConJur about the granting of the HC. “The decision corrects a very serious injustice against Esther, a professional of the highest quality, who was illegally dragged into criminal proceedings without any just cause,” he said.
Marcelo Miller's defense was carried out by lawyer Rodrigo Brocchi .
The HC also benefited Francisco de Assis e B2B Lead Silva, who was legal director of JBF at the time of the events and is now a lawyer at J&F. "The suspension of the criminal action by the TRF-1 is clear proof that there was no illegality in the hiring of the Trench Rossi Watanabe office by J&F. The decision also repairs a serious mistake made by J&F employees, responsible for the most complete and unrestricted collaboration with Justice", says Assis e Silva.

Miller was accused of having used his position in the Attorney General's Office and taking advantage of his proximity to the then PGR Rodrigo Janot to help J&F executives, as shown by conversations between executives.
Afterwards, the prosecutor left the MPF to work as a lawyer in an office in favor of J&F. Lawyer Esther Flesch ended up being considered responsible for recruiting the former prosecutor.
When Miller's double act became public, Janot called for the collaboration agreements to be terminated .
